CompaniesJuly 9 (Reuters) - A group of newspapers including the New York Times (NYT.N), opens new tab and New York Daily News asked a federal court in Manhattan on Thursday to ​sanction OpenAI in their high-stakes copyright dispute for allegedly lying to the ‌court about its ability to search its systems for proof that it misused millions of their articles in AI training.

The newspapers told the court, opens new tab in a filing that OpenAI falsely told the court ​it could not search its large language models for their copyrighted material ​while hiding that it had done so "even before the first News ⁠Plaintiff filed suit."

The newspapers said that OpenAI had also deleted billions of relevant ​ChatGPT conversations or made them unsearchable. They asked the court for sanctions, including attorneys' ​fees, and a court finding that OpenAI's chat logs showed that the company misused their copyrighted works.

Spokespeople for OpenAI did not immediately respond to a request for comment on the motion.

The lawsuit, first filed ​by the Times in 2023, accused OpenAI and its largest financial backer Microsoft (MSFT.O), opens new tab of ​using millions of its articles without permission to train the large language model behind OpenAI's popular ‌chatbot ⁠ChatGPT.

The case is one of many brought by copyright owners including authors, visual artists and music labels against tech companies such as OpenAI, Anthropic and Meta Platforms for allegedly misusing their material to train AI systems.

“For over two years, OpenAI lied to ​The Times, The ​Daily News Plaintiffs, ⁠the public, and the court," the New York Times' lead attorney Ian Crosby said in a statement. "It claimed searching ChatGPT outputs ​for copies of The Times’ and the Daily News Plaintiffs’ content ​was infeasible, ⁠burdensome, and invasive of users' privacy – while at the same time concealing that it had already done such searches."

OpenAI previously told the court that it did not have ⁠tools to ​search its datasets and output logs for copyrighted ​material, but an OpenAI employee later testified that the company had "performed multiple searches for News Plaintiffs’ content," according ​to the newspapers' Thursday filing.

As detailed below, the complaint alleges that the Company and its executives violated federal securities laws by making false and/or misleading statements and/or failing to disclose that: (1) PicS N.V. had conducted an evaluation of its credit evaluation procedures in December 2025 and determined that such procedures were deficient and in need of enhancement; (2) as a result of the new procedures PicS N.V. had implemented in December 2025, PicS N.V. had reclassified approximately R$590 million of exposures previously classified as Stage 2 to Stage 3, leading to an incremental ECL charge of R$88 million in the three months ended December 31, 2025; (3) PicS N.V. had experienced a heightened, but unreported, Stage 3 formation rate of more than 7% in the fourth quarter of 2025 that deviated substantially from the historical results and trends provided in the offering documents; (4) the IPO's offering documents had materially overstated the quality and ability of PicS N.V.'s credit models and user data to inform PicS N.V.'s underwriting practices and to allow PicS N.V. to timely and effectively monitor, assess, and identify adverse credit events, credit risks, and credit deterioration across its portfolio; and (5) PicS N.V. suffered from degradations in customer credit quality and heightened risks of default and loan impairment as a result of its entrance into materially riskier business lines leading up to the IPO, resulting in undisclosed adverse financial and operational trends such as heightened incidents of default, which predated the IPO and were internally projected by PicS N.V. to continue to worsen following the IPO, materially impairing PicS N.V.'s business, operations, and financial results.

On or around January 29, 2026, PicPay conducted its initial public offering ("IPO"), selling 22.86 million Class A common shares priced at $19.00 per share.

Then, on March 18, 2026, PicPay released its fourth quarter 2025 financial results and revealed that, as part of the Company's "annual review of expected credit loss parameters," it had made several "enhancements" to its Expected Credit Loss ("ECL") calculations, and "implemented a stricter policy to accelerate the classification of renegotiated non-performing exposures from Stage 2 to Stage 3." Consequently, "R$590 million of Stage 2 portfolio balances were reclassified to Stage 3, resulting in an ECL increase of R$88 [$17.56 million USD]." Stage 3 is the Company's highest risk category for its credit portfolio.

On this news, PicPay's stock price fell $3.56 per share, or 22.5%, to close at $12.27 per share on March 19, 2026.

Bloom Energy stock is among today’s top performers. Why are BE shares rallying? Bloom Energy Rejects Hunterbrook ReportBloom pushed back on the report’s claims about its financial results and accounting, calling them "false and misleading." The company said it stands behind the accuracy and integrity of its audited financial statements and financial reporting, and directed investors to its most recent Forms 10-K and 10-Q filed with the SEC.

Bloom also disputed Hunterbrook’s conclusions about scandium oxide, a material used in Bloom’s fuel cells. The company said it has enough scandium oxide supply to meet current fuel cell demand and backlog, and said its supply is not dependent on China.

Bloom added that it is not dependent on China to scale scandium oxide supply for future demand growth. The company said it has clear visibility into its supply chain to support production of 25GW of fuel cells per year and plans to continue expanding capacity.

Hunterbrook Questions Bloom Energy’s Scandium Supply ChainHunterbrook Media’s report questioned CEO KR Sridhar’s prior statements that Bloom is not dependent on China for scandium. Hunterbrook Capital also disclosed that it holds a short position in Bloom Energy stock.

A central part of the report is a supply-demand model that flags a potential deficit in fuel-cell-grade scandium oxide. Hunterbrook estimated Bloom alone would need roughly 220 tons to support 5 gigawatts of production expectations modeled by Wall Street, compared with about 240 tons of projected global supply.

Bloom Energy Says It Will Correct The RecordBefore Thursday’s formal response, Bloom Energy told Benzinga on Wednesday that it was aware of the report "published by a media outlet affiliated with an investment firm that has disclosed it may hold positions designed to profit from a decline in Bloom’s stock," and said it planned to issue a response.

"We are reviewing the report and will correct the record. Bloom’s fuel cell platform is supported by a diversified, multi-country supply chain built over two decades, long-standing commercial relationships, and proprietary materials-recovery technology, as described in our public filings and our July 7 blog post on scandium oxide," a Bloom Energy spokesperson said.

Critical Price Levels To Watch For BEFrom a trend perspective, the stock is still extended on the longer view after a 785.72% run over the past 12 months, and it’s trading 20.3% above the 100-day SMA ($222.79) and 59.7% above the 200-day SMA ($167.78). At the same time, it’s sitting 5.7% below the 20-day SMA ($284.22) and 4.9% below the 50-day SMA ($281.73), which frames the current bounce as a test of whether the pullback is ending or just pausing.

The market has developed a habit of shrugging off short reports almost as quickly as they appear. That isn’t entirely surprising. Many companies targeted by activist short sellers recover after management pushes back, especially during strong bull markets. 

Yet history also shows that some of Wall Street’s biggest corporate scandals were first uncovered by short sellers willing to challenge popular narratives. That makes every new report worth reading with an open mind. 

Bloom Energy (NYSE:BE) is the latest company caught in that tug-of-war, leaving investors to separate genuine risk from market noise.

Hunterbrook Raises Serious Questions Bloom Energy stock fell more than 5% yesterday after hedge fund-backed short seller Hunterbrook published an investigation alleging the company remains heavily dependent on China for scandium, a critical material used in its fuel cells. According to the report, Hunterbrook traced multiple supply routes through trade data, corporate filings, satellite imagery, and interviews that it says contradict repeated statements by Bloom management that the company has no China-dependent supply chain.

The report also questioned whether Bloom can realistically achieve its stated goal of expanding production capacity to 5 gigawatts annually, arguing that such output could require roughly 220 tons of scandium oxide — close to projected global annual supply. Those are not minor allegations.

But Bloom didn’t remain silent, forcefully rejected Hunterbrook’s conclusions and calling the claims “false and misleading.” Investors responded by sending BE shares more than 6% higher in premarket trading, effectively erasing the previous session’s losses.

Don’t Dismiss Short Sellers — Or Blindly Believe Them Investors need to separate the messenger from the message. Short sellers often receive criticism because they profit when stocks decline. Hunterbrook disclosed that it holds a short position in Bloom Energy, giving it a direct financial incentive for the stock to fall. That doesn’t automatically invalidate the research.

Short sellers frequently perform the investigative work that retail investors cannot and investment banks rarely have an incentive to publish. Some of Wall Street’s largest accounting and governance failures first surfaced because someone betting against a stock dug into public records, supplier relationships, or financial statements.

Granted, short reports can also sensationalize relatively small issues. Publishing a highly critical report after establishing a short position is a perfectly legal investment strategy, just as buying shares ahead of a bullish research note benefits long investors.

The key isn’t whether the researcher is long or short. It’s whether the evidence holds up. Hunterbrook appears to have done extensive homework and, as the saying goes, “brought the receipts.” Bloom’s equally forceful denial means investors now have two sharply different versions of the same story.

The prudent approach is to watch what comes next. Does management systematically refute Hunterbrook’s specific allegations about its scandium sourcing and production assumptions? Or do those questions quietly fade from future discussions?

The answers matter far more than one day’s price action.

Je s podivem, jak málo se v různých diskusích o dalším vývoji sazeb hovoří o tom, co se děje s finančními podmínkami. Je to podobné, jako kdyby někdo hodnotil auto bez toho, aby vůbec věnoval pozornost motoru. Což se vlastně stále více děje - v řadě recenzí se víc mluví o nastavení dotykového displeje než o pohonu. Každopádně dnes o finančních podmínkách, které se v USA posunuly docela do extrému. A pár souvisejících příbězích.

Co jsou finanční podmínky? Úplně obecně je to vše „finanční“, co se dotýká ekonomických subjektů. Tedy domácností, firem a vládního sektoru. Šlo by tedy o dlouhou řadu sazeb, druhů nákladu kapitálu, cen investičních aktiv a v neposlední řadě měnový kurz. V USA se asi nejčastěji používá index finančních podmínek od Goldman Sachs, který zahrnuje výnosy vládních dluhopisů, kurz dolaru a ceny na akciových trzích. K tomu výnosy korporátních dluhopisů, respektive jejich rizikové spready. A krátkodobé sazby.

Pokud jde křivka v následujícím grafu nahoru, finanční podmínky se uvolňují – klesají sazby a výnosy dluhopisů a/nebo oslabuje dolar a/nebo roste akciový trh (klesá náklad akciového kapitálu). A naopak pohyb dolů ukazuje na utahování finančních podmínek. Zde nejde o onen GS index, ale index Bloombergu, který mimo jiné zahrnuje i rizikové spready na mezibankovním trhu a používá jiné váhy. Ale v podstatě oba indexy nyní ukazují, že finanční podmínky jsou nyní v USA uvolněné. U Bloombergu extrémně:

Finanční podmínky svým způsobem ukazují, jakou „práci“ v danou chvíli trhy vykonávají v celé ekonomice. Zda jí spíše stimulují, nebo brzdí. Pokud pak máme jasný názor na inflaci, růst a trh práce, můžeme hovořit o tom, že trhy dělají práci za centrální banku, nebo proti ní. Co by to znamenalo nyní? Jsme v době, kdy se rychle za sebou znatelně mění výhled s tím, jak se opakovaně mění situace v Blízkém východě. Fed může v takovém prostředí vyčkávat a trhy pracovat chvíli pro něj, chvíli proti němu. Konkrétně:

Ještě nedávno šlo uvažovat o tom, že uklidňování situace na Blízkém východě přinese pokles inflačních tlaků. A pokud se vezme do úvahy zpoždění dopadu změněných sazeb, Fed by mohl tíhnout k jejich současnému snižování. Pokud do toho scénáře vložíme uvolněné finanční podmínky, trhy dělaly práci za Fed. Pokud se nyní situace zase obrátila k nedohodě a pokračujícímu konfliktu, uvolněné finanční podmínky mohou naopak dělat práci proti Fedu. V prvním případě tak snižovaly nutnost akce centrální banky, v druhém (pokud se trhy nepřenastaví) spíše zvyšují nutnost akce. Zde tedy potřebu zvedání sazeb, které by finanční podmínky pomohlo přesunout k menší uvolněnosti.

Malá technická na závěr: Docela se nyní hovoří o tom, že Fed změní způsob komunikace, opustí tzv. forward guidance, což by krátkodobě mohlo zvednout volatilitu na trzích. Hovoří se také o tom, nakolik by centrální banka měla zakládat svou politiku na aktuálním vývoji, respektive datech. Nebo na nějakém svém výhledu. I v minulosti přitom docházelo k tomu, že byl používán nějaký koncept a byly do něj vkládány naděje. A pak se jeho relevance kvůli změně prostředí rychle rozplynula.

V této souvislosti můžeme třeba zavzpomínat na snahy o dlouhodobou symetričnost inflačního cíle. Které mohly vypadat přínosně v prostředí inflace dlouhodobě podstřelující cíl ve výši 2 %. Ale nyní by nutily Fed do deflační politiky a proto o nich už neslyšíme. A směřuji k jednoduché věci – současné prostředí je hodně specifické kvůli tomu, jak jedná americká vláda. V tomto prostředí „co krok to nápad“ se pak může lehce stát, že testy nových a starých myšlenek nebudou zrovna vypovídající.

Excluding China, clinical sequencing consumables demand increased 20% for the second straight quarter.

NovaSeq X placements in the quarter exceeded 80 units, around 20 more than a year ago and above the company’s targeted quarterly range. Transition progress also continued, with approximately 82% of volumes and 55% of revenues migrated to the platform, while roughly 90% of research and applied volume now runs on NovaSeq X. Management continues to plan for average quarterly NovaSeq X placements of 50 to 60 through 2026 while investing to scale supply given the current pipeline. Meanwhile, Illumina continues to expand its oncology menu as customers scale sequencing in clinical decision-making and in new trials that require larger information sets.

ILMN’s balance sheet also remains in solid shape. The company exited the first quarter of 2026 with cash and cash equivalents of $1.09 billion compared with $1.42 billion at the end of fourth-quarter 2025. Current debt was $499 million, unchanged sequentially, while long-term debt remained $1.49 billion.

Peabody characterizes itself as a leading producer of metallurgical and thermal coal and has promoted Centurion, its underground longwall metallurgical coal mine in Queensland, Australia. According to the company, the mine commenced full-scale production in February 2026.

The litigation is focused on the propriety of Peabody's statements about Centurion's operational status and production capabilities.

For example, Peabody's management informed investors on February 5, 2026 that "the team was installing the very last shield and putting the finishing touches on the Centurion Mine[,]" and "our team is charged up and has started mining some of the best metallurgical coal in the world." Then, on May 5, 2026, Peabody reported its Q1 2026 financial results. Of particular concern pertaining to Centurion, management revealed the truth about why it slashed the mine's Q1 production assurance.

Despite telling investors in February that it was mining Centurion and would produce 700,000 tons in Q1, a new narrative emerged – "as part of our commissioning in February, we encountered temporary mechanical and electrical issues" – and "[a]s a result, our full year sales outlook for Centurion is now 2.5 million tons compared to our original expectation of 3.5 million tons." This full year 28% reduction helped send the price of Peabody shares down nearly 6%.

Furthermore, the different grades of the Zacks Rank are applied proportionately across all stocks for which brokerage analysts provide earnings estimates for the current year. In other words, at all times, this tool maintains a balance among the five ranks it assigns.

Another key difference between the ABR and Zacks Rank is freshness. The ABR is not necessarily up-to-date when you look at it. But, since brokerage analysts keep revising their earnings estimates to account for a company's changing business trends, and their actions get reflected in the Zacks Rank quickly enough, it is always timely in indicating future price movements.

Should You Invest in ANET?In terms of earnings estimate revisions for Arista Networks, the Zacks Consensus Estimate for the current year has remained unchanged over the past month at $3.63.

Analysts' steady views regarding the company's earnings prospects, as indicated by an unchanged consensus estimate, could be a legitimate reason for the stock to perform in line with the broader market in the near term.

The ability to identify stocks that are likely to top quarterly earnings expectations can be profitable, but it's no simple task. Here at Zacks, our Earnings ESP filter helps make things easier.

The Zacks Earnings ESP, ExplainedThe Zacks Earnings ESP, or Expected Surprise Prediction, aims to find earnings surprises by focusing on the most recent analyst revisions. The basic premise is that if an analyst reevaluates their earnings estimate ahead of an earnings release, it means they likely have new information that could possibly be more accurate.

Now that we understand the basic idea, let's look at how the Expected Surprise Prediction works. The ESP is calculated by comparing the Most Accurate Estimate to the Zacks Consensus Estimate, with the percentage difference between the two giving us the Zacks ESP figure.

When we join a positive earnings ESP with a Zacks Rank #3 (Hold) or stronger, stocks posted a positive bottom-line surprise 70% of the time. Plus, this system saw investors produce roughly 28% annual returns on average, according to our 10 year backtest.

Stocks with a ranking of #3 (Hold), or 60% of all stocks covered by the Zacks Rank, are expected to perform in-line with the broader market. Stocks with rankings of #2 (Buy) and #1 (Strong Buy), or the top 15% and top 5% of stocks, respectively, should outperform the market; Strong Buy stocks should outperform more than any other rank.
