Memory chip prices could severely affect Apple's business During Cook's last earnings call, he stated that rising memory chip prices are undergoing a "100-year flood." Essentially, nobody could have seen this coming, and the effects could be disastrous. He noted that Apple already had to raise prices on some products, but it may not be able to stop at just a few product lines. If prices continue to rise, it could force Apple to raise prices again, alienating some of its consumer base, which is already stretched thin.

However, Cook noted that it is decreasing costs on other components that help offset rising memory chip prices. We'll see how this pans out, but if prices continue to rise, it could get ugly for Apple and cause John Ternus to deal with a crisis just a few months into the job.

To make matters worse, Apple's stock is priced for perfection. For the most part, Apple has executed nearly flawlessly under Cook's leadership. This has led to a sky-high valuation.

Apple (AAPL +0.29%) is worth about $4.54 trillion, up 51% over the past year -- a gain of more than $1.5 trillion.

For scale, the whole company was worth about $580 billion a decade ago. In other words, the value Apple added in the past 12 months is more than two and a half times the value of the entire business in August 2016.

Numbers like that make the long view worth taking. So, what did the past decade actually pay an investor who bought and held -- and how much of the gain came from the business itself, versus the market simply paying more for the same earnings?

The split matters, because one of those two drivers can repeat. The other probably can't.

What $10,000 became In August 2016, Apple shares traded at about $27, adjusted for the company's 2020 stock split. As of this writing, the stock sits at about $311, an 11.5-fold increase. That move alone turns a $10,000 investment into about $115,000. Reinvested dividends push the total to about $126,000, or about 12.6 times the original stake.

The dividend's small role is its own lesson. Apple's payout is about twice what it was then on a split-adjusted basis, and a share bought in 2016 has returned a meaningful chunk of its original cost in cash.

However, the stock rose so much faster than the payout grew that the yield shrank from about 2% then to 0.35% today, on an annual dividend of $1.08 per share. The gain came almost entirely from the share price, not the income.

Where the gain came from Two things produced the 11.5-fold move: earnings growth and a bigger multiple on those earnings. Both did heavy work.

The earnings growth was the larger contributor. In fiscal 2016, Apple earned $8.31 per share ($2.08 adjusted for the split) on revenue of $215.6 billion and net income of $45.7 billion. Over the trailing 12 months, earnings per share reached $8.72, about a fourfold increase.

And it took more than product sales to get there. Apple retired about a third of its shares over the decade, from nearly 22 billion split-adjusted shares to about 14.6 billion, so each remaining share claims a bigger slice of the profits. The high-margin services business helped, too. The company's gross margin reached 50.1% in its most recent quarter.

To me, the buyback is the underappreciated part of the decade. It explains a quirk in the numbers. Apple's market value grew about eightfold over the stretch, from $580 billion to $4.54 trillion, while the share price grew 11.5-fold. The difference is the shrinking share count.

The other factor is the valuation multiple. In August 2016, the market paid about 13 times earnings for Apple. Today it pays about 36 times. That near-tripling, stacked on the fourfold earnings growth, accounts for essentially the entire 11.5-fold move.

And that's the uncomfortable half of an otherwise happy exercise. Thirteen times earnings was the price of a company the market saw as a maturing hardware maker. Thirty-six times prices Apple as something far more durable. The multiple arguably can't triple again. From today's level, that would mean more than 100 times earnings.

So, if the next decade is going to reward shareholders, the business has to do nearly all the rewarding.

To the company's credit, the earnings side looks healthy. Apple's fiscal third quarter of 2026 (the period ended June 27), reported in late July, was its best June quarter ever -- and Tim Cook's last full one as CEO before he hands the job to John Ternus on Sept. 1. Revenue rose 16% year over year to $109.4 billion, and earnings per share climbed 29% to $2.02, a figure that included an $0.11 benefit from tariff refunds. Even excluding that item, earnings grew about 22%. The company also said its installed base of active devices reached another all-time high.

Sure, none of this gets easier at Apple's size. Apple's annual revenue has nearly doubled over the decade to more than $400 billion, and growing earnings by double digits from that base is a taller order than it was in 2016.

Ultimately, I'd still keep owning Apple. It remains a high-quality business with unusual staying power, and I think artificial intelligence (AI) features spread across its enormous installed base could drive years of device upgrades.

But I'd own it with this decade's math in mind. That 12.6-fold gain came with a tripling multiple attached, and the next stretch has to be earned by earnings. If it is, the stock can still do well from here. But I certainly wouldn't count on $10,000 becoming $126,000 again.

iPhone-maker Apple is suing OpenAI over allegations of stolen trade secrets. A legal battle between Apple and OpenAI over the ChatGPT maker's secretive device project escalated this week when the artificial intelligence (AI) developer called the iPhone maker's allegations "baseless" and asked for the lawsuit to be dismissed.

Apple sued OpenAI last month in San Jose, California, accusing the AI company of orchestrating a campaign to steal the iPhone maker's trade secrets through former employees as it tries to develop its own consumer hardware device.

In a new court document filed Monday, Apple described OpenAI's actions as "repeated instances of deliberate theft."

"OpenAI should not be permitted to use Apple's secrets to gain an unjust head start in its hardware ambitions," the iPhone maker says.

OpenAI hit back Wednesday and called for the case to be permanently dismissed, which would bar Apple from filing another lawsuit on the same grounds.

"Apple built its reputation by paying close attention to the smallest details. This lawsuit does the opposite," OpenAI's lawyers say in their filing, which continues to describe Apple's complaint as "rotten to its core."

Federal Judge Edward Davila will consider both requests at a hearing Oct. 1.

Partners and rivals Meanwhile, the two companies remain partners, since ChatGPT has been integrated into Apple products since 2024.

"Apple should not be permitted to use a baseless and pretextual lawsuit to make up for its shortcomings in the market for talent and in retaining its employees, and its failures to integrate AI into its products," OpenAI's lawyers say.

They invoke California laws that "encourage" employees to take new jobs—policies that are "credited with powering the tech revolution that has made companies based in this state the envy of the world."

More than 400 former Apple employees currently work at OpenAI, according to the initial complaint.

"The harm is happening now," Apple's lawyers say, and "every day that passes without an injunction allows OpenAI to embed their knowledge of Apple's stolen information into its hardware development efforts."

Smart speaker To convince the judge of the urgency, Apple's lawyers submitted a TechCrunch article describing leaked details about OpenAI's highly anticipated first device: a screenless smart speaker designed in collaboration with LoveFrom, a studio founded by Jony Ive, Apple's famed former head of design.

On Thursday, Bloomberg reported that the device would be circular like a donut, about the size of a hockey puck, and cost between $300 and $400, with a launch planned for 2027.

OpenAI has never confirmed these leaks.

"OpenAI has no use, need or desire for Apple's trade secrets," the creator of ChatGPT says in a court document, which continues that Apple hasn't named any specific products, such as an iPhone, that have allegedly been copied. "OpenAI is building something entirely new and different."

Apple, for its part, accuses OpenAI's head of hardware, Tang Tan, a former vice president of design at Apple, of using his knowledge of unreleased Apple products to extract information from job candidates.

OpenAI asked candidates to bring "prototypes" and design files to interviews for "show and tell" sessions—an American classroom exercise in which students present objects to their classmates—Apple alleges.

In its response, OpenAI says it follows standard industry practices.

According to his lawyers, Tan "repeatedly instructed recruits and his team not to bring or disclose former employers' confidential information."

OpenAI also defends itself by accusing Apple of failing to properly protect its own data, claiming that the Cupertino company has "encouraged employees to use personal iCloud accounts for work, intermingling company and personal data, while failing to manage access cleanly across multiple Apple systems when employees departed."

The case comes at a sensitive time for OpenAI, which is worth a reported $852 billion as it works toward a potential IPO. The lab is also locked in fierce competition with Anthropic, a rival AI lab in San Francisco founded by a group of former OpenAI employees.

OpenAI Seeks Dismissal of Apple Trade Secrets Lawsuit

OpenAI asked a judge to dismiss Apple’s lawsuit accusing the company of stealing trade secrets.

The artificial intelligence startup said Apple’s claims have no merit, and its lawsuit falsely portrays its employees’ actions, according to documents filed Wednesday (Aug. 5) by OpenAI in federal court.

“Apple built its reputation by paying close attention to the smallest details,” the filing said. “This lawsuit does the opposite. Plainly filed without adequate investigation and built on selectively excerpted communications and ordinary conduct stripped of context, Apple’s complaint is—to borrow its own phrase—‘rotten to its core.’”

OpenAI Chief Hardware Officer Tang Tan was acting in accordance with industry recruiting standards when interviewing Apple employees, according to the filing. OpenAI technical staff member Chang Liu, who was accused of theft, was trying to help a former colleague at Apple, and not—as the iPhone maker alleged—attempting to purloin trade secrets.

“Apple should not be permitted to use a baseless and pretextual lawsuit to make up for its shortcomings in the market for talent and retaining its employees, and its failures to integrate AI into its products,” OpenAI’s filing said.

Apple did not reply to PYMNTS’ request for comment.

Apple filed its lawsuit last month, alleging that Tan and Liu stole trade secrets to support the development of devices at OpenAI.

The suit alleged Tan emailed himself information about Apple’s suppliers and asked Apple employees to bring parts with them when interviewing for jobs with OpenAI. Apple also claimed Liu downloaded confidential files from Apple’s network and instructed an Apple employee how to copy confidential files.

Apple said in the suit that it doesn’t know what OpenAI did with the information but alleged that “at every level, from members of its Technical Staff to its Chief Hardware Officer, and in coordination with business partners, OpenAI has been stealing Apple’s trade secrets and confidential information.”

Days after the suit was filed, the Financial Times reported that Apple sent letters to around 40 ex-employees now working for OpenAI, demanding they preserve documents and communications and meet with Apple attorneys. Roughly 400 former Apple employees now work at OpenAI.

The ChatGPT maker said in a court filing this week that Apple's lawsuit accusing it of stealing trade secrets amounted to sour grapes after it fell behind in the AI talent war.

"Apple should not be permitted to use a baseless and pretextual lawsuit to make up for its shortcomings in the market for talent and retaining its employees," OpenAI said in the filing, in which it asks a judge to dismiss Apple's suit.

Big Tech companies have fought each other for talent over the last couple of years, offering staggering wages and other benefits in efforts to poach a limited pool of top engineers from rivals.

Meta, for example, has managed to steal some of OpenAI's top researchers. It lured Shengjia Zhao, the cocreator of ChatGPT, last year. Meta also hired away Alexandr Wang to lead its superintelligence team by buying the company he started, Scale AI, for $15 billion.

In its lawsuit, Apple said the total number of Apple alums now working at OpenAI exceeds 400.

Apple sued OpenAI in July, alleging the ChatGPT maker benefited from trade secrets stolen by former Apple employees hired away by OpenAI. The lawsuit alleges, among other things, that Chang Liu, a veteran Apple engineer, improperly retained and accessed confidential company information after leaving for the AI lab in January.

In OpenAI's latest filing, the company said it's common practice to recruit top talent from Apple and other companies.

"OpenAI does have an interest in hiring the best engineers, inventors, developers and creators — many of whom have decided to leave Apple and to come to OpenAI, attracted by the innovative and exciting work the company is doing," the AI startup said in the filing.

An Apple spokesperson told Business Insider in a statement Thursday that "significant evidence has emerged suggesting individuals employed by OpenAI wrongfully took Apple's secret and confidential information regarding our unreleased technologies."

Apple has not yet filed a response in court to OpenAI's filing, and a judge has not ruled on the request for a dismissal. In a blog post on Monday, OpenAI said, "We do not have, nor want, any of their trade secrets."

OpenAI’s motion to dismiss Apple’s trade secrets lawsuit, along with newly filed exhibits, reveals the company’s legal defense strategy. Rather than focusing on whether former Apple employees working at OpenAI had accessed certain information, the AI company argues that Apple’s own security practices and offboarding procedures weaken its claim that the information qualifies as legally protected “trade secrets.”

Apple’s complaint, filed in July, accuses OpenAI of orchestrating a scheme to obtain confidential hardware information from former Apple engineers. This week, Apple asked the court to expedite discovery, saying its internal investigation indicates some additional former employees may have participated in, or witnessed, the alleged theft of trade secrets.

In its motion, OpenAI argues that Apple allowed employees to use personal iCloud accounts for work and failed to properly revoke access after they left the company. It also submitted text message records showing that an Apple manager remained logged into the personal iCloud account of defendant and former Apple engineer Chang Liu after he left the company to transfer files, and later asked him for help with technical questions about Apple projects.

OpenAI also accuses Apple of omitting the consequences of its own “inexplicable information-management practices” from its original complaint, noting that the company failed to properly secure its systems when employees departed, creating confusion and unwanted access issues that Apple now characterizes as theft.

While this may sound a bit like a “the door was unlocked, so it wasn’t really stealing!” defense, this argument is meant to strengthen OpenAI’s argument that former Apple employees were simply trying to assist their prior colleagues. It could also help push the narrative that these weren’t truly trade secrets if they weren’t secured as such.

OpenAI argues Apple hasn’t specified which “trade secrets” or confidential components were allegedly stolen, referring to them instead as “generic categories of the product-development process—such as component manufacturing, product testing, vendor and supplier relationships, and distribution channels.”

OpenAI’s filing posits that Apple is using this lawsuit to slow down its competitor from innovating in AI-powered hardware, rather than focusing on its own product plans.

Výraz Mag7 popisující sedmičku oblíbených velkých technologických společností se stále intenzivně používá. Je ale podle mě vysoce pravděpodobné, že jednou to s ním bude třeba jako s dnes už v podstatě zapomenutou skupinou BRIC. První fází tohoto odchodu z prémiové pozice by mohly být valuace. Dnes o nich právě z pohledu „prémiové“ a většinové skupiny, k tomu pár úvah o dalším pokračování současného valuačního cyklu.

Největších pět firem v indexu S&P 500 nyní představuje NVIDIA, Apple, Microsoft, Amazon a Alphabet. V roce 2000 to byly General Electric, Microsoft, Cisco Systems, Walmart a ExxonMobil. To samo o sobě ukazuje, jak mohutné jsou posuny z prémiových pozic. A uvádím to i jako úvod k následujícímu grafu. Ten ukazuje, jak se vyvíjel poměr cen akcií k ziskům u pětky největších společností na trhu a u zbylých 495 akcií. Celkově tu vidíme dva cykly, kdy rostou valuace na celém trhu a zároveň se největší akcie svým PE odtrhávají od zbytku trhu. Pak se zase tato mezera uzavírá. Nyní jsme právě v této fázi, předchozí valuační mezera nyní v podstatě vymizela:

PE největších firem v tomto druhém cyklu nedosáhlo na maxima z vrcholu technologické bubliny. Ovšem valuace zbytku trhu, tedy bezpochyby také řady velmi zajímavých společností „Mag495“, se ale v současném cyklu dostaly v podstatě na podobné úrovně, jako tehdy. U podobných časových srovnání PE je ale dobré si občas připomenout, že mohou porovnávat hrušky s jablky. V tom smyslu, že do valuací se významnou měrou promítají bezrizikové sazby, hlavně zřejmě výnosy desetiletých vládních dluhopisů.

Dejme tedy tomu, že trh má nyní podobné valuace, jako před čtvrt stoletím. Kdyby ale byly dnešní bezrizikové sazby třeba poloviční, než tehdy, znamená to, že současný optimismus na trhu je znatelně menší, než tehdy. Současnému PE by totiž na podobné úrovně jako před 25 lety mnohem více pomáhaly bezrizikové sazby. Tehdy by zase mnohem větší „práci“ musel dělat optimismus. Jak je to ale konkrétně? Následující graf ukazuje, že nyní se výnosy desetiletých obligací pohybují pod 5 %, do roku 2000 k této úrovni mířily shora:

Pokud tedy dáme stranou možný psychologický efekt z toho, že tehdy šly výnosy k 5 % směrem odshora a nyní to je odspoda, tak v bezrizikových sazbách nějaký masívní rozdíl nenajdeme. Takže ve výše uvedené logice to znamená, že (i) nyní u pěti největších společností na trhu panuje výrazně menší optimismus, než před cca 25 lety. A (ii) u Mag495 je optimismus stejný, jako tehdy. Optimismem přitom myslím kombinovaný efekt rizikových prémií a očekávaného dlouhodobého růstu zisků a hlavně volného toku hotovosti.

Pokud by se nyní celý cyklus rýmoval s tím předchozím, začaly by nyní klesat i valuace Mag495 a dál by klesalo i PE velké pětky. K tomu bych připomněl, že PE může klesat méně příjemným způsobem, tedy přes pokles čitatele (tedy ceny akcií). Nebo příjemným způsobem, přes růst jmenovatele, tedy zisky (a samozřejmě je tu celá škála kombinací). K tomu si vezměme třeba následující kalkulaci:

Dejme tomu, že nějaké udržitelné, či v cyklu průměrné PE trhu je kolem 16 (viz první graf). Nyní se pohybuje kolem 20. Dejme tomu, že požadovaná návratnost je nyní u amerických akcií 4,7 % bezrizikových sazeb plus 3 % riziková prémie. Tedy asi 8 %. Takže v ideálním scénáři chceme, aby PE korigovalo k 16 a P zároveň rostlo ročně o 8 %.

V pětiletém horizontu bychom toho na základě jednoduché kalkulace dosáhli, kdyby zisky obchodovaných společností rostly o 13 %. A shodou okolností jsem tu včera psal, že pětiletá očekávání pomyslného konsenzu jsou nyní podle dat Yardeni Research na 25 %. Tedy téměř na dvojnásobku. Ovšem téměř stoleté zkušenosti ukazují, že průměrný růst zisků je mezi 6 – 7 % ročně. Tedy na cca polovině oněch 13 %.

The stock still fell as much as 8% in after-hours trading because the market's objections centered on what comes next: supply constraints, rising supply costs, and a share price that had already climbed to about 40 times earnings.

The quarter itself left little to criticize. Earnings per share rose 29% year over year to $2.02, net income climbed 27% to $29.8 billion, and iPhone revenue jumped 22% to $54.3 billion. Mac revenue grew even faster, up 29%.

The company's gross margin expanded, too, reaching 50.1% against 46.5% a year earlier. Also worth noting, the quarter's earnings included an $0.11-per-share benefit from tariff refunds. Excluding it, earnings per share still grew about 22%.

"Today, Apple is proud to report our strongest June quarter ever, with double-digit revenue growth across iPhone, Mac and Services, and in every geographic segment," Cook said in the earnings release -- his last as CEO. John Ternus takes over on Sept. 1, and Cook becomes executive chairman.

Services, which may have been one reason shares sold off, was the softest of Apple's three biggest revenue categories. Revenue there rose about 12% year over year to $30.7 billion -- a June-quarter record and the category's 12th straight quarter of double-digit growth, but the slowest growth of the three. And the high-margin services business is the line the stock's premium valuation leans on most.

The outlook is almost certainly another reason investors were disappointed. Apple warned that supply constraints will weigh on iPhone, iPad, and Mac in the September quarter, and Cook said the company expects to pay even higher memory costs in the period than it just did, with memory prices rising across the industry. Apple guided September-quarter gross margin to 47% to 48%, down from the 50.1% it just posted.

And then there's the price of the stock. Shares came into the report near their record high, up about 65% from their 52-week low, trading at about 40 times earnings. At that valuation, even the best June quarter in Apple's history arguably just confirms what the market already believed: shares were getting ahead of themselves.

For shareholders, I don't think Thursday's reaction says anything new about the business. Apple grew by double digits in every geographic segment, its installed base of active devices reached another all-time high, and the CEO handoff has been telegraphed since April. The after-hours slide looks less like a business problem and more like a pricey stock taking a breather.

Overall, however, Ternus inherits a company growing faster than it has in years, and a stock already priced for it. I'd keep holding.

Apple's (AAPL +1.96%) flagship iPhone business was nothing less than stellar in its recently reported fiscal third quarter. Revenue of $54.25 billion was not only up nearly 22% but also topped analysts' expectations of $53.86 billion. The iPhone also led a companywide beat of Q3 earnings and sales outlooks, offsetting its services arm's revenue shortfall.

Apple's iPhone franchise, however, may be even more of a workhorse than Apple's limited data disclosure about the popular smartphone suggests.

Leading the unit growth race Apple stopped reporting the total number of iPhones it sold in any given quarter back in 2019, reducing transparency into the health of about half of the company's revenue. But the technology industry's researchers and data intermediaries didn't stop keeping score.

Using information gathered in other ways, IDC continued to tally the total number of smartphones that the business's biggest players shipped. To this day, it continues to provide quarterly unit shipments for major smartphone manufacturers.

That's where things get interesting and encouraging. According to IDC, Apple was only one of two major names in the smartphone business to defy the overall 6.7% year-over-year decline in total smartphone shipments during the second calendar quarter of this year. The other one was Samsung, which experienced an 8.1% year-over-year increase in total unit shipments. Apple handily outpaced that growth rate, though, with its 15.3% year-over-year improvement in iPhone shipments, again as reported by IDC.

Two key takeaways There are a couple of important takeaways for investors quietly buried in this data. The first is that, while the company itself didn't report it, the relative changes in reported revenue and unit shipments indicate that Apple is asking -- and getting -- a higher average selling price (ASP) for its current slate of iPhones. And not for the first time.

This is the second quarter in a row that IDC reported Apple had defied a broad drop in demand for smartphones by achieving the industry's highest year-over-year increase in unit shipments, which again was also outpaced by Apple's reported iPhone revenue growth (of nearly 22% in the previously reported quarter).

Connect the dots. After a slow start, the demand for newer iPhones that the launch of Apple Intelligence was supposed to generate back in 2025 is finally taking hold. Now-outgoing CEO Tim Cook even made a point of highlighting how upgrades largely drove the company's "incredible blowout" fiscal Q3 earnings to the iPhone 17 launched late last year.

The other nuance to recognize is that this swell of fresh demand materialized right before Apple is set to unveil and launch the next generation of its iPhone. The media event scheduled for early next month will feature a new iPhone 18 that powers a new-and-improved AI-powered digital assistant, Siri, that is at least somewhat better than the iPhone 17's. Consumers are buying the 17 anyway.

The lesson here is that with some appropriate tweaks and a fair number of new features, Apple can still convince millions of people to upgrade their iPhones -- or even switch from competitors. Apple is reportedly working on one of the most important iPhone revamps it has introduced in years. The company will apparently launch a foldable version of the device, according to some reports. Considering the massive success some smartphones have had in this niche, an iPhone Fold could meaningfully expand Apple's installed base and power more impressive sales growth in the coming years.

2. A growing installed base During its third quarter, Apple's installed base reached an all-time high across all categories and geographic segments. Apple has asked a federal judge to slam the brakes on OpenAI’s hardware ambitions, leading the ChatGPT maker to fire back that the iPhone giant’s own lawyers couldn’t even email the right Asian executive

The Cupertino, Calif.-based behemoth sought a preliminary injunction late Monday barring OpenAI and two former Apple staffers from accessing, using or sharing what it claims are stolen trade secrets, warning the court it faces irreparable harm without one.

Hours later, OpenAI hit back with a blistering blog post that branded the suit “careless, aggressive and oddly personal” — and accused Tim Cook’s Apple of botching basic facts.

OpenAI said Apple now admits its outside lawyers emailed the wrong man after mixing up two Asian surnames and the company only came clean once the artificial intelligence giant pointed out the blunder.

“Apple had claimed that they contacted OpenAI in February and that we didn’t respond. They now admit that their outside lawyers emailed the wrong person after confusing two Asian last names — only after we brought this to their attention,” OpenAI said.

Emails published by the company show Weil, Gotshal & Manges partner Gabriel Gross sent his warning letter to OpenAI general counsel Che Chang instead of a former Apple employee surnamed Wang.

Gross also thanked Chang for a phone call that OpenAI says never took place, which is a claim it says Apple has since walked back.

A baffled Chang forwarded the note to Apple’s in-house lawyers, writing that he had never spoken to Gross and did not know who he was.

OpenAI said that Apple’s lawyers emailed the wrong Asian executive and only realized it once the Sam Altaman-led firm pointed it out. Apple filed its bombshell complaint July 10 in the Northern District of California, accusing OpenAI of running a months-long scheme to loot its hardware secrets as the startup races to build its first consumer device.

The suit names Chang Liu, a former senior system electrical engineer, and Tang Yew Tan, Apple’s ex-vice president of product design for the iPhone and Apple Watch, who now leads OpenAI’s hardware effort.

Apple claims Liu used a former colleague’s laptop to siphon dozens of confidential hardware files after he quit, while Tan allegedly forwarded supplier details to his personal email and coached incoming hires on skirting Apple’s exit process.

OpenAI called the injunction request needless, insisting it neither holds nor wants any Apple secrets.

The startup also released a trove of iMessages that it says flips Apple’s story on its head. The texts show Apple employees pleading with Liu for help tracking down files and technical details after his final day — with one former colleague joking that Liu was “the best” source, “even if you don’t work here anymore.”

OpenAI said any lingering access to Apple systems stemmed from the iPhone maker’s own sloppy offboarding, which leaves departed workers connected to company files they never asked to keep.

On Monday, the AI company published a blog post titled "Apple is getting this wrong," accusing the iPhone maker of presenting a misleading account of the events behind its trade-secret lawsuit. OpenAI highlighted what it said were errors in Apple's legal correspondence and released messages that it said provided important context about the dispute.

"Apple is one of the greatest companies of all time, and built a reputation for obsessing over the smallest details," the post says. "This careless, aggressive and oddly personal lawsuit sadly doesn't live up to that reputation."

Apple sued OpenAI in July, alleging that the ChatGPT maker benefited from trade secrets taken by former Apple employees. The lawsuit alleges, among other things, that Chang Liu, a veteran Apple engineer, improperly retained and accessed confidential company information after leaving for the AI lab in January.

OpenAI — which is trying to develop its own hardware products — previously denied wrongdoing, saying it is not interested in Apple's secrets.

Monday's post takes the AI lab's defense a step further. It said that Apple employees reached out to Liu after he left for OpenAI in January and said Apple is "failing to properly manage system access when people leave."

Elon Musk, the outspoken Tesla and SpaceX CEO who lost a lawsuit against OpenAI and its leaders earlier this year, reposted screenshots of Apple's latest court filings on Tuesday.

Todd Dailey, former Apple enterprise marketing manager Todd Dailey, a former Apple enterprise marketing manager who spent 22 years at the company according to his LinkedIn, said his own departure made OpenAI's statements about Apple's offboarding problems seem plausible.

On X, he wrote that he still had two unreleased Apple prototypes.

"Old Apple wouldn't have let an ex-employee hold a prototype for more than 24 hours and would have sent someone to my door to get it," Dailey wrote.

He said the experience reflected how stretched Apple's employees had become and made it easier to understand how the company's lawyers could have made mistakes in their correspondence with OpenAI.

"I'm not surprised at all that busy, harried lawyers could make this mistake," he wrote.

Harpal Singh, founder of Blimpp Harpal Singh, the founder of the generative-engine-optimization platform Blimpp, told Business Insider that OpenAI's post was written to directly contradict Apple's account.

That tactic, he said, could affect how journalists, search engines, and AI tools describe the lawsuit.

"OpenAI is not just defending itself in court," Singh said. "It wants to present the narrative that journalists, search engines, and other AI Response Systems will mirror."

Apple has filed a trade secrets lawsuit against OpenAI. CFOTO/Future Publishing via Getty Images One notable detail to emerge from the brewing legal battle between Apple and OpenAI isn't about trade secrets at all — it's about workplace culture and internal AI use.

In a series of iMessages released Tuesday as part of OpenAI's public response to Apple's trade secrets lawsuit against it, a former Apple engineer-turned-OpenAI staffer at the center of the case suggested that working at OpenAI was markedly different from working at Apple.

"This place is crazy… hahahah we use Ai all over the place," Chang Liu said in a text message to one of his former Apple colleagues shortly after he left the iPhone maker earlier this year to join ChatGPT creator OpenAI.

Liu, who spent eight years at Apple as a senior system electrical engineer and is named among the defendants in Apple's lawsuit, said in another text made public by OpenAI: "This startup style company is a funny and will be very hard in a couple months😁😁."

The messages offer a rare glimpse into one engineer's inside perspective on Apple, a 50-year-old company, and OpenAI, a decade-old startup, as the tech companies race to build the next generation of AI.

The texts were among a collection of messages and emails that OpenAI published in a blog post titled "Apple is getting this wrong," as it defended itself against the company's lawsuit.

OpenAI released text messages it said were from Chang Liu.  OpenAI Apple's federal lawsuit accuses OpenAI, along with Liu and Tang Tan — a former Apple employee and current OpenAI hardware chief — of stealing Apple's confidential information.

The lawsuit accuses the defendants of "exploiting Apple's confidential information to advance OpenAI's efforts to enter the consumer hardware market."

In the Tuesday blog post, OpenAI slammed Apple's July lawsuit as "careless, aggressive and oddly personal" and said, "We do not have, nor want, any of their trade secrets."

"Apple accuses Chang Liu of accessing Apple confidential information after leaving the company, but only now admits that Apple employees reached out to him and asked for his help to locate this information," OpenAI wrote.

Beyond the legal fight, Liu's text messages underscore a seemingly broader contrast between Apple and OpenAI's internal approaches to artificial intelligence.

While Apple executives have publicly described AI as increasingly integrated across the company, they have offered relatively few details about how employees use large language models in their day-to-day work.

On an earnings call last year, Apple CEO Tim Cook said the company sees AI "as one of the most profound technologies of our lifetime," adding, "We are embedding it across our devices and platforms and across the company."

OpenAI execs, on the other hand, have openly detailed how AI is integrated across the business. Former OpenAI chief product officer, Kevin Weil, said on "Lenny's Podcast" last year that company employees use AI "a lot."

"I mean, every one of us is in ChatGPT all the time summarizing docs, using it to help write docs with GPTs that write product specs and things like that — all the stuff that you would imagine," Weil said.

Representatives for OpenAI and Apple did not immediately respond to requests for comment by Business Insider on Tuesday.

After this report, however, Wall Street seems far less forgiving.

That question—whether Apple's cautious approach to AI is a hidden strength or a real weakness—now sits at the very heart of the investment case.

Strong Fundamentals, Steep ExpectationsTo be sure, this is far from being a story about a struggling company. Apple's underlying business remains formidable, with revenue growing at a double-digit pace, earnings smashing expectations, and profitability metrics that most companies could only dream of.

That strength is exactly why the stock has commanded such a premium for so long. iPhone sales have been robust, Apple’s high-margin Services division continues to gather momentum, and the sheer scale of the cash Apple generates gives it options few others possess. On the numbers alone, this is a wonderful business performing well.

The problem is that a wonderful business isn't always enough to justify 40% gains in the weeks before a fresh report, especially when investors have found a shiny new thing to chase, and Apple isn't a clear beneficiary.

Why the Bears Smell a Real GapThe bearish argument is that Apple has quietly fallen behind in the one area that matters most to investors right now—AI. While its peers have spent enormous sums scaling their own AI models and infrastructure, Apple's strategy has looked comparatively defensive, even leaning on its peers’ technology to power parts of its revamped Siri product.

The result, the skeptics argue, is that Apple still lacks a globally available AI product compelling enough to justify the recent gains. Worse still, it’s now finding itself on the wrong side of the AI boom in a second way, since surging demand for memory and advanced chips is inflating its own component costs. In that sense, the company arguably loses twice, paying more to build its devices while not yet reaping an AI windfall to compensate.

This fed directly into the disappointing guidance from Apple’s management. A meaningful chunk of the expected slowdown was pinned on AI-driven supply shortages, and regulatory friction has left the new Siri features delayed in Europe and unavailable in China, two of Apple's most important markets.

It was against this backdrop that GF Securities took the rare step of downgrading the stock to Hold last week, arguing that at more than 30 times forward earnings, the shares are too expensive given "AI is not yet a visible engine."

The Bulls See a Hidden StrengthThe counterargument is that Apple is playing a completely different game. Rather than burning through cash to compete with the hyperscalers on raw infrastructure, Apple can weave AI into its hardware and services and monetize it over the upgrade cycle, all without the crippling capital expenditure weighing on its rivals.

There’s a compelling logic to this. Apple's approach is capital-light by design, and its enormous installed base gives it a ready-made distribution channel the moment its AI features truly resonate.

Some bulls go further, noting that the current iPhone upgrade cycle is being driven by hardware improvements rather than AI at all, which means the real AI-powered supercycle may still lie entirely ahead.
